Welcome to RYZZFIT! By accessing or using our website, mobile applications, and services, you agree to be bound by these Allgemeine Geschäftsbedingungen (AGB). These terms govern the legal relationship between you, the user, and RYZZFIT. If you do not agree, please refrain from using our services. official language : English
1. Scope of Services
RYZZFIT provides fitness-related services, including but not limited to:

Group classes

Fitness plans

Nutritional advice

Access to online resources via our platform
Services may vary depending on location and subscription type. Availability is subject to change at RYZZFIT’s discretion.
2. Eligibility
2.1. General Requirements
RYZZFIT services are available to individuals with full legal capacity. Users under 18 must comply with the additional conditions outlined below.
Accurate Information: Users must provide accurate, complete, and up-to-date information during the registration process and throughout their use of RYZZFIT services. Failure to do so may result in the termination of their membership.
2.2 Age Restrictions
Participation in RYZZFIT services is restricted to individuals aged 16 and above.
2.3 Minors (16-17 Years Old)
Minors aged 16-17 may access RYZZFIT services only with prior written consent from a parent or legal guardian. The consent must include:

Contact details of the parent/guardian.

A copy of a valid ID from the parent/guardian to verify legal authority.
2.4 Age and Consent Verification
RYZZFIT reserves the right to verify age and authorization documents. Failure to provide accurate information may result in suspension or termination of services.
2.5 Acknowledgment of Risk
Participation in fitness activities involves inherent risks, including physical injury or health complications. By using RYZZFIT services, users acknowledge and accept these risks and agree to the following:

Assumption of Responsibility: Users assume full responsibility for their participation in RYZZFIT activities.

Health Confirmation: Users confirm that they are in adequate health and do not have any medical conditions that could impair their participation. Each member is advised to perform a medical check within 7 days before starting the RYZZFIT membership. For data privacy reasons (storage of medical data), RYZZFIT will not request a copy of this medical check unless required by law or specific circumstances.

Liability Waiver: Users waive liability claims against RYZZFIT for injuries or losses, except in cases of gross negligence (grobe Fahrlässigkeit) or intentional misconduct (Vorsatz) by RYZZFIT. This waiver does not affect users' statutory rights under German consumer protection laws.
2.6 Health and Safety Disclosure Policy
2.6.1. Mandatory Health Disclosure
All users participating in RYZZFIT activities (including but not limited to workouts, training sessions, classes, and events) must fully disclose any pre-existing medical conditions, injuries, physical limitations, or health concerns that may affect their ability to engage safely.
This includes, but is not limited to:

Cardiovascular conditions (e.g., heart disease, high blood pressure)

Respiratory issues (e.g., asthma, chronic bronchitis)
-
Musculoskeletal injuries (e.g., recent surgeries, joint problems, chronic pain)
-
Neurological disorders (e.g., epilepsy, vertigo)
-
Pregnancy or postpartum conditions
-
Any other medical or psychological condition that may pose a risk during physical activity
2.6.2. Medical Clearance Requirement
If a user has a known medical condition, RYZZFIT reserves the right to require a hard copy of the clearance from made a licensed physician or healthcare professional mentioned in paragraph 2.5.
Users recovering from surgery, illness, or injury must provide documentation confirming their fitness to engage in physical exercise by respecting paragraph 2.5.
2.6.3. Assumption of Risk & Liability Waiver
By participating in RYZZFIT activities, users acknowledge that they are voluntarily engaging in physical exercise and assume all associated risks.
Failure to disclose relevant health information voids any liability claims against RYZZFIT, its trainers, staff, or affiliates for injuries, aggravations of existing conditions, or other health complications.
2.6.4. Membership Termination for Non-Disclosure
RYZZFIT reserves the right to immediately suspend or terminate the membership of any user who fails to disclose critical health information that could jeopardize their safety or the safety of others.
No refunds will be issued for terminations resulting from undisclosed health conditions.
2.6.5. Ongoing Responsibility to Update Information
Users must promptly inform RYZZFIT of any new or worsening health conditions that arise after initial registration. Trainers or staff may request updated health information as well as a new medical check before allowing safe participation.
2.6.6. Emergency Situations
In the event of a medical emergency, RYZZFIT staff will take reasonable steps to assist, including contacting emergency services. However, users are responsible for any medical expenses incurred.
2.6.7. Compliance with Safety Instructions
Users must follow all safety guidelines provided by RYZZFIT trainers. Refusal to comply with modifications or restrictions due to health concerns may result in removal from the membership without a refund.
2.7 Compliance with Local Laws
Users must comply with all local laws and regulations applicable to their use of RYZZFIT services. RYZZFIT is not responsible for any violations of local laws by users.
2.8 Membership Transferability
RYZZFIT memberships are non-transferable. Users may not transfer their membership or any associated benefits to another individual without the express written consent of RYZZFIT.
2.9 Membership Termination
RYZZFIT reserves the right to terminate a user's membership at any time for any reason, including but not limited to violation of these terms and conditions, misuse of services, or failure to provide accurate information.
In case the cancellation is due to a non-respect of the terms and conditions, no refund will be allowed. Otherwise, a refund for the non-performed services will be issued.
2.10 Updates to Eligibility Criteria
RYZZFIT reserves the right to update or modify the eligibility criteria at any time. Users will be notified of any changes, and continued use of RYZZFIT services will constitute acceptance of the updated criteria.
2.11 Member selection
RYZZFIT reserves the exclusive right to accept or decline membership applications at its sole discretion. The evaluation of applicants may be based on, but is not limited to, factors such as demonstrated motivation, respectful conduct, positive attitude, and commitment to personal well-being.
3. Payments & Refunds
3.1. Pricing
Service prices are listed on the website and are inclusive of legally mandatory taxes applicable. Prices are subject to change with prior notice. In case of a change, no retroactive pricing update is applicable - a member will always pay the price of his membership at the moment of his registration.
3.2. Payment Methods
Payment can exclusively be performed online on the RyzzFit Website. Payment can be performed in 1, 2, or 4 times if explicitly allowed by the corresponding Freelancer. Fees paid to RyzzFit Berlin are distributed to the respective freelancers after deducting platform/organizational costs (if applicable).
3.3. Payment Due Date
Apart from the trial session (free of charge) and trial app period, no RyzzFit service will begin prior to payment.
3.4. Absence of automatic Reconduction (except RYZZFIT App)
None of the RYZZFIT training packages is automatically renewable. After a package is over, it is up to the client to extend, modify, or stop their RYZZFIT membership. RYZZFIT keeps the right to refuse the extension or reconduction of a client, without providing any justification.
RYZZFIT App is subject to an automatic payment (for the people available), and can be stopped any month either directly on the website or by sending a request to info@ryzzfit.com at least 5 working days before the next date of the contract renewal.
3.4. Pricing evolution
Once a membership has been paid, the agreed price is fixed for the duration of the corresponding service period. Any subsequent increase in package pricing will not affect the existing agreement, and no additional payment will be required. Conversely, no partial refund shall be issued in the event of a price decrease. In the case of a contract renewal or extension, the applicable rate will be the package price in effect at the time of renewal.
3.5 Discounts
RYZZFIT may, at its sole discretion, offer discounts or preferential pricing on a case-by-case basis, including but not limited to considerations of financial hardship. Such discounts are granted voluntarily and do not constitute a contractual obligation or precedent. RYZZFIT reserves the right to modify or withdraw any discount offer at any time without prior notice.
3.6 Referrals
RYZZFIT may, at its sole discretion, offer benefits or rewards for member referrals. Any such benefits are granted voluntarily and do not create an obligation or entitlement. RYZZFIT reserves the right to determine the nature, conditions, and availability of referral rewards and may modify or discontinue such offers at any time without prior notice.
3.7 Membership Structure
Within all membership packages, only personal training sessions are considered to have a defined monetary value. Additional services—such as access to the mobile application, WhatsApp support, group events or other complimentary features—are provided as free bonuses and do not carry any financial value. As such, these supplementary services are not eligible for refund, compensation, or claim, including in the event of service interruption, early termination, or cancellation of the membership.
3.8 Service Location
Training sessions may take place at the member’s home, outdoors, or in one of the EVO gyms in Berlin. RYZZFIT does not guarantee the use of a specific gym location; training venues may change as required for service delivery. Any location outside of RYZZFIT Rosenthaler Platz (Berlin) must receive prior explicit approval from RYZZFIT staff.
For service quality and safety reasons, RYZZFIT does not conduct sessions in hotel gyms under any circumstances. Such facilities typically lack the equipment, space, and environment required to meet RYZZFIT's training standards, and are therefore deemed unsuitable for effective and professional coaching.
If a member refuses to train at RYZZFIT Rosenthaler Platz and the staff, for any reason, decline all alternative locations proposed by the member, the membership may be cancelled without refund. Online sessions may be offered as an exceptional alternative, at RYZZFIT’s sole discretion.
Group events may take place at various locations, including outdoor or third-party venues. The time, place, and conditions of each group event are announced on a case-by-case basis, and participation is optional unless otherwise specified.
4. Membership Interruptions
4.1 Trainer Unavailability
In case of trainer illness/unavailability, sessions will be rescheduled within 21 days. Refunds are available for unused sessions if rescheduling fails.
4.2 Gym Access Issues
In the event that all EVO gym locations become temporarily inaccessible, RYZZFIT will make reasonable efforts to relocate sessions to other partner gyms. If relocation is not possible within 21 calendar days, members may request a refund for any unused sessions. Refunds are limited to the value of the personal training sessions only and exclude any additional, non-monetary services.
4.3 Force Majeure
RYZZFIT is not liable for interruptions caused by events beyond its control (e.g., natural disasters, covid lock-down). Services will resume as soon as possible or be maintained online if possible. Otherwise, refunds for unfulfilled sessions will be issued if the interruption exceeds 360 days.
5. Privacy and Data Security
5.1 Data Collection and Processing
RyzzFit collects and processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). We only collect data necessary for providing our services, including but not limited to:

Name, contact details (email, phone number, address)

Payment and billing information

Health and fitness-related data (if applicable for training purposes)

Website/app usage data (cookies, IP addresses, analytics)
5.2 Legal Basis for Processing
RYZZFIT processes personal data on the following legal grounds:

The necessity to fulfill our contractual obligations with you (Art. 6(1)(b) GDPR)

RyzzFit implements industry-standard security measures to protect your data, including:

5.4 Data Sharing & Third Parties

5.6 Data Retention

We may update this policy to reflect legal changes. Continued use of our services constitutes acceptance of the revised terms.
6. Intellectual Property Rights
6.1 Ownership of Content
All intellectual property rights in and to RyzzFit (including women branch: HERA), including but not limited to:

Logos, trademarks, and brand elements (registered or unregistered)

Website content, training programs, and digital materials

Software, apps, and proprietary technology

Marketing materials, videos, and written content
are the exclusive property of RyzzFit or its licensors and are protected under German copyright law (UrhG), EU copyright directives, and international IP treaties.
6.2 Limited License for Users
RyzzFit grants you a non-exclusive, non-transferable, revocable license to access and use our services for personal, non-commercial purposes, subject to these Terms. You may not:

Copy, modify, or distribute RyzzFit materials without written permission

Use our trademarks or branding without prior consent

Reverse-engineer, decompile, or exploit our software/apps
6.3 User-Generated Content
If you submit content (e.g., reviews, photos, or feedback), you:

Grant RyzzFit a royalty-free, worldwide license to use, display, and modify it for promotional and operational purposes

Confirm you own or have the rights to share such content

Agree not to post infringing, illegal, or harmful material
6.4 Copyright Infringement & DMCA Compliance
RyzzFit respects third-party IP rights. If you believe our services infringe your rights, notify us immediately with:

We comply with the EU Copyright Directive and will act promptly on valid claims.
6.5 Penalties for Violations
Unauthorized use of RyzzFit’s IP may result in:

Immediate termination of your account

Financial damages (including lost profits and legal fees)
7. Refund Policy
7.1 General Refund Conditions
Users have the right to cancel their purchases within 14 days in accordance with German consumer protection law.
Refund eligibility is subject to the status of the services provided:

Full Refund: If no services have been commenced, a full refund will be issued.
-
Partial Refund: If services have begun, a non-refundable fee of €50 (or €100 for duo sessions) will be retained to cover the creation of your personal diet and workout plans. The remaining amount will be refunded proportionally based on the number of unused sessions.
Example:
If 8 sessions were purchased for €400, and 5 sessions have been completed, 3 sessions remain unused. The refundable amount would be calculated as follows:
3/8 × (€400 − €50) = €131.25.
7.2. Refund Process
Refund requests must be submitted via email at info@ryzzfit.com under 14 days of purchase. Refunds are processed within 14 business days. No refund beyond the refund request period will be accepted unless exceptionally agreed by RYZZFIT staff.
7.3. Non-Refundable Cases
Sessions canceled under the following conditions will be considered as performed and are not eligible for refund or rescheduling:

Cancellations made less than 24 hours before the scheduled session, unless supported by valid medical justification (a medical certificate may be requested).

Failure to attend a scheduled session without prior notice (no-shows).
Exceptions may be granted at the sole discretion of RYZZFIT staff. RYZZFIT strives to be understanding and accommodating in reasonable circumstances, such as cancellations due to painful periods, which are generally accepted as valid reasons.
8. Legal Status
8.1 Nature of RyzzFit
RyzzFit is not a legal entity (e.g., GmbH, UG, or e.K.) but a collective name used by independent freelancers (each a "Provider") offering fitness training and wellness services in Berlin, Germany. Each Provider operates as a self-employed individual under German laws (§ 18 EStG, § 2 HGB).
8.2 No Employer-Employee Relationship
Providers collaborate under the RyzzFit name but:

Retain full autonomy over their services, schedules, and client agreements.
-
Are solely responsible for their tax, social security, and legal compliance.
-
Do not act as agents or employees of RyzzFit or other Providers.
8.3 Client Contracts
When you book a service through RyzzFit, your contract is directly with the individual Provider, not with RyzzFit as a brand. Each Provider:

Sets their own prices, cancellation policies, and service terms.
-
Issues invoices under their personal/freelancer name (not RyzzFit).
-
Bears liability for their services (§ 611a BGB).
8.4. Liability limit
RyzzFit, as a collective name, assumes no liability for the acts, omissions, or services of individual Providers. Clients must address claims directly with the responsible freelancer. Providers are independently insured and comply with German professional liability requirements.
8.5. Hera
Hera is a branch of RyzzFit which only serves as commercial purposes for women specialized training but is not an independent legal structure
8.6. Partners
RyzzFit related freelancers are free to work with any other partner based and their will and do not owe any money or service time to RYZZFIT.
9. RYZZFIT APP – Terms of Use
9.1. Access and Elegibility
The RYZZFIT APP (the "App") is accessible under the following conditions:

Active Monthly Subscription: Users with a valid paid subscription.

Former Clients (8 or 12-Session Packages): Access granted for 6 months from the last session.
-
Former Clients (4-Session Package): Access granted for 3 months from the last session.
RYZZFIT reserves the right to verify eligibility and restrict access if terms are violated.
9.2 Availability and service interuption
Uninterrupted Access Not Guaranteed: The App may experience downtime due to maintenance, technical issues, or other operational reasons.
Termination of Service: RYZZFIT reserves the right to discontinue the App or its features at any time without prior notice. For app subscribers, If service is terminated before the end of a billing cycle, users will receive a proportional refund based on unused days. For Packages subscribers no refund is available as the app is a free gift associated to your personal training sessions
Example Calculation: Subscription renews on the 10th of each month. Service ends on the 1st of the same month.
Refund = (Monthly Price × 9 Unused Days) / Total Days in Month.
No Refunds for Expired or Non-Subscription Access: Former clients (4/8/12-session packages) are not entitled to refunds upon service termination.
9.3 User Responsabilities
Account Security: Users must keep login credentials confidential. Unauthorized sharing may result in immediate access revocation.
Prohibited Use: Reverse engineering, scraping, or commercial exploitation of the App is forbidden.
9.4 Disclaimer and Limitation of liability
The App is provided "as is"—RYZZFIT does not guarantee fitness results or uninterrupted functionality. No liability for indirect damages (e.g., injury, data loss, missed workouts) arising from App use is acceptable.
10. Risk acknowledgement
10.1 Personal Responsibility
By using the RYZZFIT App or participating in any RYZZFIT training sessions, you acknowledge that: You are solely responsible for your personal safety, belongings, and health. RYZZFIT and its affiliated freelancers do not insure against theft, loss, or damage to personal property (e.g., phones, bags, fitness gear). You agree to secure valuables and use facilities at your own risk.
10.2 No Liability for Property Damage or Theft
RYZZFIT does not compensate for stolen, lost, or damaged items in training venues (studios, outdoor spaces, etc.). If lockers are provided, they are used at your own risk—no guarantee of security.
10.3 Physical Injury & Health Risks
You confirm you are medically fit for physical activity and have consulted a doctor if necessary. RYZZFIT and its trainers are not liable for injuries (e.g., strains, sprains) resulting from:

Incorrect use of equipment.

Failure to follow instructions.
-
Pre-existing health conditions.
10.4 Force Majeure & Third-Party Risks
RYZZFIT is not responsible for incidents caused by:

Third parties (e.g., other gym users, bystanders).
-
Unforeseen events (natural disasters, riots, or "höhere Gewalt" under § 7 BGB).
10.5 Reporting Incidents
Any theft, damage, or injury must be reported immediately to the trainer and venue staff. Filing a police report (for theft/damage) is the user’s responsibility.
10.6 Insurance Recommendation
Users are advised to obtain personal liability insurance (Privathaftpflichtversicherung) and health/accident coverage.
