1. Introduction

Welcome to RYZZFIT! By accessing or using our website, mobile applications, and services, you agree to be bound by these Allgemeine Geschäftsbedingungen (AGB). These terms govern the legal relationship between you, the user, and RYZZFIT. If you do not agree, please refrain from using our services.

2. Scope of Services

RYZZFIT provides fitness-related services, including but not limited to:

  • Personal training sessions

  • Group classes

  • Fitness plans

  • Nutritional advice

  • Access to online resources via our platform

Services may vary depending on location and subscription type. Availability is subject to change at RYZZFIT’s discretion.

3. Eligibility

3.1 General Requirements

RYZZFIT services are available to individuals with full legal capacity. Users under 18 must comply with the additional conditions outlined below.

3.2 Age Restrictions

Participation in RYZZFIT services is restricted to individuals aged 16 and above.

3.3 Minors (16-17 Years Old)

Minors aged 16-17 may access RYZZFIT services only with prior written consent from a parent or legal guardian. The consent must include:

  • A signed authorization letter using the provided template (see website for details).

  • Contact details of the parent/guardian.

  • A copy of a valid ID from the parent/guardian to verify legal authority.

3.4 Age and Consent Verification

RYZZFIT reserves the right to verify age and authorization documents. Failure to provide accurate information may result in suspension or termination of services.

3.5 Acknowledgment of Risk

Participation in fitness activities involves inherent risks, including physical injury or health complications. By using RYZZFIT services, users acknowledge and accept these risks and agree to:

  • Assume full responsibility for their participation.

  • Confirm they are in adequate health and do not have medical conditions that could impair participation.

  • Waive liability claims against RYZZFIT for injuries or losses, except in cases of gross negligence or intent.

4. Account Registration and Security

4.1 Account Creation

Users may be required to create an account by providing accurate and complete registration details. Users are responsible for maintaining the confidentiality of their credentials.

4.2 Account Security

RYZZFIT must be informed immediately of unauthorized access or account misuse. RYZZFIT is not liable for damages resulting from user negligence.

4.3 Termination of Accounts

RYZZFIT reserves the right to suspend or terminate accounts for:

  • Violations of these terms

  • Suspected fraud

  • Misuse of services

5. Booking Policies

5.1 General Booking Rules

Bookings can be made up to one month in advance. Late bookings within 24 hours are subject to availability. Sessions are confirmed only upon trainer approval.

5.2 Cancellations and Rescheduling

  • Users may cancel or reschedule up to 24 hours before the session without penalty.

  • Cancellations or reschedules within 24 hours may incur the full session fee.

5.3 Late Cancellations and No-Shows

  • Late cancellations or no-shows will be charged in full.

  • Membership session cancellations within 24 hours will count as used.

5.4 RYZZFIT-Initiated Cancellations

  • RYZZFIT may cancel sessions without prior notice. Single session cancellations will be fully refunded. Membership session cancellations will be rescheduled within 10 days. If rescheduling is not feasible after three attempts, the session will be refunded.

6. Payment Terms

6.1 Pricing

Service prices are listed on the website and are inclusive of VAT. Prices are subject to change with prior notice.

6.2 Payment Methods

Payment must be made in advance via approved methods (credit card, PayPal, etc.). Users must ensure payment details are accurate.

6.3 Invoices

Invoices or receipts will be sent electronically. Paper invoices are available upon request.

6.4 Late Payments

Late payments may incur statutory interest charges. Access to services may be suspended until payment is made.

7. Refund Policy

7.1 General Refund Conditions

Users may cancel purchases within 14 days in accordance with German law. Refund eligibility depends on the status of the service:

  • Full Refund: If services have not commenced.

  • Partial Refund: For services already started, refunds are prorated.

7.2 Medical and Relocation Refunds

Refunds beyond 14 days are available only for:

  • Medical conditions requiring 14+ days of inactivity (proof required).

  • Permanent relocation outside Berlin (proof required).

7.3 Refund Process

Refund requests must be submitted via email or phone within 14 days of purchase. Refunds are processed within 5-7 business days.

7.4 Non-Refundable Cases

Refunds are not provided for:

  • Cancellations within 24 hours

  • No-shows

  • Services rendered beyond the refund window

8. Privacy and Data Security

8.1 Compliance

RYZZFIT adheres to GDPR and German data protection laws. Personal data is collected only for service provision and improvement.

8.2 Data Collection and Use

Data collected includes contact information, payment details, and fitness-related information. Data is used solely for:

  • Service delivery

  • Payment processing

  • Communication

8.3 Data Security

RYZZFIT employs measures to protect user data from unauthorized access. Only authorized personnel may access user data.

8.4 Third-Party Sharing

Data is not shared without user consent, except as required by law or for payment processing.

8.5 User Rights

Users may request access, correction, or deletion of their data by contacting RYZZFIT at info@ryzzfit.de.

9. Intellectual Property

9.1 Ownership

All content on RYZZFIT platforms is owned by RYZZFIT or its licensors and protected by intellectual property laws.

9.2 License

Users are granted a non-transferable license for personal use of RYZZFIT content.

9.3 Prohibited Use

Copying, distribution, or modification of RYZZFIT content without permission is prohibited.

10. Liability Disclaimer

10.1 General Disclaimer

While RYZZFIT strives for accuracy, users rely on platform information at their own risk.

10.2 Liability Limitation

RYZZFIT’s liability is limited to gross negligence or intent. Liability for personal injury or death is governed by statutory provisions.

10.3 User Responsibility

Users accept responsibility for risks associated with fitness activities and agree to consult a healthcare professional as needed.

11. Membership Interruptions

11.1 Trainer Unavailability

In case of trainer illness, sessions will be rescheduled within 21 days. Refunds are available for unused sessions if rescheduling fails.

11.2 Gym Access Issues

If the gym is inaccessible, sessions will be relocated. If relocation is not possible within 21 days, unused sessions will be refunded.

11.3 Force Majeure

RYZZFIT is not liable for interruptions caused by events beyond its control (e.g., natural disasters). Services will resume as soon as possible, and refunds for unfulfilled sessions will be issued if the interruption exceeds 30 days.

12. Amendments to Terms

12.1 Right to Amend

RYZZFIT may update these terms to reflect changes in services or legal requirements. Changes will be communicated via email or website notification.

12.2 Effective Date

Amendments take effect on the date specified in the notification.

12.3 User Acceptance

Continued use of services constitutes acceptance of revised terms.
